The specific details of the services I will provide to you will be agreed upon in a separate proposal or contract.
 

3. Prices and Payment

  • My prices for services will be outlined in my proposals or contracts.

  • Unless stated otherwise, all prices are exclusive of VAT (as I am not currently VAT registered). If this changes, I will let you know.

  • I require a 50% deposit before starting any design work.

  • The remaining 50% balance is due upon completion of the project and before I send over the final design files.

  • I accept bank transfers [and any other methods you accept].
     

4. Intellectual Property
 

  • The initial copyright and all other intellectual property rights in the designs I create remain with Laura Kloos Design until you have paid the final balance in full.

  • Once I have received full payment, the full copyright and ownership of the final approved designs will be transferred to you.

  • Laura Kloos Design retains the right to use the completed design work in my portfolio for the purpose of showcasing my work and self-promotion. I will aim to do this only after the designs have been publicly launched by you, unless otherwise agreed. I also retain the right to be credited for the design work.

  • If you specifically request that I do not use the work in my portfolio, please let me know in writing.
     

5. Your Responsibilities
 

  • You are responsible for providing me with clear and accurate information, feedback, and materials (such as text, images, and brand guidelines if they exist) that I need to provide the services.

  • You are responsible for ensuring that you have the necessary rights to use any materials you provide to me.

  • You agree to review my designs and provide feedback in a timely manner.
     

6. My Liability
 

  • I aim to provide my services with reasonable care and skill.

  • My liability to you for any loss or damage arising from my services is limited to the total amount you have paid me for those services.

  • I am not liable for any indirect, special, or consequential losses.

  • Nothing in these terms and conditions will limit or exclude my liability for death or personal injury caused by my negligence, or for fraud or fraudulent misrepresentation.  
     

7. Cancellation and Termination
 

  • You have the right to cancel a service within 14 days of agreeing to it, if you are a consumer (an individual acting outside of their business). However, if you ask me to start work within this 14-day period, you may lose your right to cancel once the work has begun.

  • Either party may terminate the agreement if the other party seriously breaches these terms and conditions and fails to correct the breach within a reasonable time.

  • If you cancel after work has begun, you may be responsible for paying for the work completed up to the point of cancellation.
     

8. Governing Law and Disputes
 

  • These terms and conditions and any agreement between us will be governed by and interpreted in accordance with the laws of England and Wales.  

  • Any disputes arising under these terms and conditions will be subject to the exclusive jurisdiction of the courts of England and Wales.
